Contractor Agreement – General
The Contractor
You will need good practical agricultural skills and knowledge, and the ability to use and maintain farm machinery. You will also need good organisational skills so that you can work to deadlines. If additional help is required for the work to be done then the contractor will be expected to employ a third person (s) of their choice. Such costs will be dealt with by the contractor and should be fullly covered by the agreed rate in this contract.
Expertise Required
The contractor will be expected to have appropriate knowledge, experience and, (if legally required), qualifications / certification before undertaking work such as;
· Crop spraying / Pesticide application
· Applying fertiliser (solid and slurry)
· Harvesting
· Seed processing –
· Fencing
· Excavation & drainage work
· Crop protection
· Soil and water management
The contractor should be up-to-date with all regulations pertaining to these activities and should never knowingly contravene the regulations when undertaking work on behalf of the company.
Equipment
The contractor will be required to supply, operate and maintain machinery and equipment suitable for the work to be undertaken.
Insurance
The contractor agrees that any work done on the property of Geostart Agri will be done at their own risk. The contractor is expected to be self insured to cover any accidents incurred whilst undertaking designated work. The company expects all contractors to undertake a risk assessment before undertaking any work and not to take any untoward risks when operating on the property.
Any damage done to drains, hedges, fences, gates etc will need to be repaired by the contractor, or at the contractors expense.
Cancellation Rights
In the event that the contractor is having difficulty in meeting the companies deadlines or requirements then the company reserves the right to award work to another contractor. All contractors are encouraged to be forthcoming ASAP if they foresee that they will be unable to undertake the work within the required period.
Location & Facilties
Camus farm is located in Colerain, Northern Ireland.
The contractor will have access to the company land 24/7 if required, for the purpose of undertaking the contract. The contractor is welcome to use the farmyard area for the purpose of storing materials, parking plant, cleaning etc during the period of work activity. Water, power and toilet facilities are available.
Invoicing and Payment
The contractor will be expected to submit a VAT invoice to the company shortly after completing the assigned work. The invoice should include the following:
- Invoice number,
- VAT Number
- Address of the contractor
- Date of invoice
- Details of Service carried out, date undertaken and agreed rate for the work.
- If the contractor includes their bank details and email address on the invoice then payment will be made electronically into the account and an email sent to advise of payment. The company will endeavour to pay the contractor within two weeks of receiving the invoice. The contractor is encouraged to send the invoice as an email attachment rather than rely on the postal system.
Governing Law
This agreement is governed by the laws of Northern Ireland, a jurisdiction within the UK. Any dispute which arises between Company and Contractor will be dealt with by the Courts of Northern Ireland.
